TITLE: JURY/WITNESS DUTY AND SUBPOENAES

PURPOSE

To define the benefit parameters and the administrative procedures for engaging in jury or witness service.

STATEMENT

Bargaining Unit Employees
Benefits and processes for employees subject to collective bargaining agreements are governed by those respective agreements; failing such provisions, Board policies and Administrative Rules shall apply.

Management, Exempt, Confidential and Part-Time Staff
The college encourages employees to fulfill their civic duties. Employees will generally be allowed leave to serve on a jury, if summoned. If service may pose an economic or business hardship, the college may provide supporting documentation for a request to be excused.

Benefit and Procedures
Employees serving on jury duty shall receive leave with pay for their regularly scheduled work hours by logging all time spent in jury service on their time sheet. Compensation received by the employee for jury service during work time, (excluding compensation for travel and expenses), shall be signed over to the college. The employee may keep compensation provided by the court for jury service performed on a noncontract day or otherwise outside of normal working hours.

While serving on jury duty, employees must keep their supervisor apprised of their status; including changes to schedule and their expected date or return to work. During jury duty, if the employee is either not required to report or released during scheduled work time, they must communicate with their supervisor, and either report to work, or utilize paid leave accruals to remain in fully paid status. 

An employee subpoenaed on behalf of the college as a witness will receive leave with full pay for all scheduled work time spent in witness service. For part-time staff, any hours spent in such service, which extend beyond regularly scheduled work time, will be paid at the regular hourly rate.  To facilitate such payment, time served must be logged in detail on the employee’s time sheet.  Any compensation received by the employee for such service (excluding compensation for travel and expenses) shall be signed over to the college.

Employees who are subpoenaed or otherwise ordered to appear before a court or jury, in a matter to which they are either an individual party or witness, shall, if applicable, use their accrued paid leave.  Examples of this include, but are not limited to, criminal or civil cases, traffic court, divorce proceedings, custody hearings or other court-ordered appearances.  

In the event that an employee is preparing for and/or participating in legal proceedings related to domestic violence, harassment, sexual assault or stalking, the employee shall use paid sick time.

Upon request, the president or a designee may approve exceptions to this mandatory application of paid leave.
